Abstract

The practice of homosexuality and same-sex relationships in Nigeria is not a new phenomenon, but one that has consistently been a subject of clandestine practice due to societal and religious disapproval, as well as the stigma attached to individuals who identify as such. Over the years, Nigerian statutes have included provisions prohibiting the practice of homosexuality. Despite the global trend of acceptance and recognition of same-sex relationships as human rights, particularly championed by the West, Nigeria remained resolute in her stand against the acceptance of same sex relationships, by enacting the Same-Sex Marriage Prohibition Act of 2013. Adopting the doctrinal research methodology, through the examination of relevant statutes, judicial authorities, Constitutional provisions and other relevant secondary sources, this article will appraise the provisions of Nigeria’s Same-Sex Marriage Prohibition Act 2013, using it as a tool to assess the status of LGBTQIA+ rights in Nigeria.
